Operation Bluebird Inc. ("Bluebird," "we," "us," or "our") provides a service that enables people to connect with others and to store, post, and share content. This Privacy Policy explains the personal information we collect, how we use and disclose it, the choices available to you, and how to contact us.

This Privacy Policy forms part of the policies referenced in Bluebird's Terms of Service. If you do not agree with this Privacy Policy, do not use the Service.

By accessing this Service, you understand and explicitly acknowledge that Bluebird and its Service are not associated in any way with X.com, the X social media app, X Corp., or any of its related companies.

1. Personal information we collect. The personal information we collect depends on how you use Bluebird and the information you choose to provide. Based on the functions described in our Terms of Service, we may collect the following categories.

Information you provide.

Account information. Information used to create, maintain, secure, or identify your account, such as your name, username, email address, password or other account credentials, and other profile information you choose to provide.

User Content. Text, documents, graphics, images, audio, video, comments, posts, and other media or files that you store, post, upload, publish, submit, transmit, or otherwise make available through the Service. User Content may include information about you or other people.

Reports, appeals, and safety requests. Information you provide when you report content, an account, or activity; request review of a moderation or account decision; or communicate with us about safety or enforcement. A qualifying intimate-image removal request may include a signature, information sufficient to locate the image, a good-faith statement, contact information, and information showing authority to act for another person.

Copyright and legal notices. Information submitted in a copyright notice, dispute notice, arbitration opt-out, or other legal request, including contact information, statements, signatures, and information needed to evaluate or respond to the request.

Feedback and communications. Comments, ideas, feedback, questions, and other information you send to us.

Information generated through use of the Service.

Service and account activity. Information about activity on Bluebird that is needed to operate the Service, provide features, identify interests, protect accounts, enforce our policies, investigate suspected violations, and maintain records of reports and decisions.

Content and interaction information. Information about User Content and related interactions, including whether content is made publicly available, stored, shared, reported, labeled, restricted, reduced in visibility, referred for human review, removed, or retained by other users.

Safety, integrity, and moderation information. Information developed through automated systems, human review, or both, including assessments about possible spam, fraud, manipulation, policy violations, and the apparent authenticity, accuracy, reliability, context, or source of publicly available User Content.

Inferences and recommendations. Interests and other inferences derived from account activity, User Content, and related information, including information used for recommendation, content-moderation, safety, and other data-driven systems.

Information from other people and organizations.

We may use personal information to:

Artificial intelligence and automated systems.

Bluebird may use artificial intelligence, machine learning, and other automated systems to analyze publicly available User Content and related information. These systems may help operate, protect, and improve the Service; detect spam, fraud, manipulation, and policy violations; assess the apparent authenticity, accuracy, reliability, context, or source of content; make recommendations; and help determine whether content should be labeled, restricted, reduced in visibility, referred for human review, or removed.

Automated assessments may be incomplete, inaccurate, or affected by context unavailable to Bluebird. An automated assessment is not a definitive determination that content is true or false. When available, you may use Bluebird's reporting or appeal process to ask for review of a decision affecting your content or account.

Bluebird may also use User Content and related information to develop, train, test, evaluate, and improve AI and machine-learning models, algorithms, content-moderation tools, recommendation systems, safety systems, and other data-driven technologies used by or for Bluebird. Service providers may assist with these activities under contractual restrictions. Deleting User Content may not remove information, patterns, or improvements previously incorporated into a trained model or system, except where applicable law requires removal.

2. How we disclose personal information.

We may disclose personal information in the following circumstances:

To other users and the public. User Content and profile or account information you make available through Bluebird may be visible to other users or the public. Other users may store, share, reproduce, modify, or distribute that content as permitted by the Service and the Terms.

To service providers. We may engage service providers to help operate, protect, and improve the Service, including assisting with AI and machine-learning development, training, testing, evaluation, content moderation, recommendations, and safety. We require appropriate contractual restrictions for these activities.

For legal, safety, and enforcement purposes. We may preserve or disclose information when reasonably necessary to investigate or enforce the Terms and other policies; comply with applicable law, legal process, or lawful requests; cooperate with law enforcement; protect users, Bluebird, or others; or establish, exercise, or defend legal claims.

At your direction or with your permission. We may disclose information when you direct us to do so, authorize the disclosure, or use a feature designed to share information.

3. Public Information and your choices.

Think carefully before making User Content public. Information made public through Bluebird may be viewed, copied, stored, shared, or used by others. Even after you delete content or deactivate your account, copies may remain with other users or in backups, archives, audit records, or other records maintained as described below.

Account information. Keep your account information accurate, complete, and current. Protect your password and notify us promptly of unauthorized use.

Content deletion. You may remove User Content by using the applicable deletion function. Some content may not be completely removed, including content stored or shared by other users and information retained for backup, archival, audit, safety, legal, or operational purposes.

Reports and appeals. You may report suspected violations to [email protected]. When Bluebird offers an appeal or review process, you may use it to challenge a decision affecting your content or account.

4. Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain your account, comply with law, preserve evidence, resolve disputes, enforce our policies, protect safety and security, and maintain backup, archival, or audit records. Following deletion of User Content or termination or deactivation of an account, we may retain User Content and related information for a reasonable period for backup, archival, audit, safety, legal, or operational purposes.

Retention periods may differ depending on the type of information, why it was collected, whether it remains necessary for legitimate operational or legal purposes, and applicable legal requirements. As described above, deletion may not remove information, patterns, or improvements previously incorporated into a trained model or system, unless applicable law requires removal.

5. Security

We use measures designed to protect User Content, accounts, and personal information. No security measure is perfect, and we cannot guarantee that unauthorized third parties will never defeat those measures. You are responsible for keeping your password and account details confidential and for notifying us promptly of suspected compromise or unauthorized use.

6. Children and teens

Bluebird is not available to children under 13. We do not knowingly collect personal information online from a child under 13. If you believe a child under 13 has provided personal information to Bluebird, contact us at [email protected]. We will take appropriate steps consistent with applicable law.

A user must also be old enough under applicable law to consent to the processing of personal information. If a user is under the age of majority where the user lives, the user's parent or legal guardian must review and agree to the Terms on the user's behalf. Additional protections or consent requirements may apply to teens under state law.

7. US state privacy rights

Depending on where you live and whether the relevant law applies to Bluebird or a particular processing activity, you may have rights regarding your personal information. These may include the right to request access to or confirmation of processing; obtain a copy; request correction or deletion; request information about categories of personal information, sources, purposes, and recipients; opt out of certain targeted advertising, sales, sharing, or profiling; limit certain uses of sensitive personal information; withdraw consent where processing relies on consent; and appeal a decision on a request. You may also have a right not to receive discriminatory treatment for exercising a privacy right.

To submit a privacy request, email [email protected] and state that you are making a U.S. state privacy request. Describe the right you wish to exercise and provide the information reasonably necessary to identify your account and verify your request. We may ask for additional information to verify your identity or authority. We will use verification information only for verification and related compliance purposes.

Where permitted by law, an authorized agent may submit a request for you. We may require proof of the agent's authority and may ask you to verify your identity or confirm the request directly. If we deny a request, you may appeal by replying to our decision or emailing [email protected] with the subject line "Privacy Appeal." You may also contact your state attorney general or other regulator where applicable.

If California privacy law applies, the sections above describe the categories of personal information Bluebird may collect, the categories of sources, the business or commercial purposes for collection and use, and the categories of recipients. The categories described may include identifiers and account information; User Content, communications, and other information you provide; internet or other electronic activity relating to use of Bluebird; and inferences or assessments generated from that information. Bluebird may disclose these categories to service providers and, when you make information available through the Service, to other users or the public. We may also disclose relevant categories for legal, safety, and enforcement purposes.

California residents may have rights to know, access, correct, and delete covered personal information; receive information about collection, use, disclosure, sale, or sharing; opt out of sale or sharing; limit certain uses or disclosures of sensitive personal information; and receive equal service and pricing, subject to applicable exceptions. Submit a request using the method above.

8. Third-party services

Bluebird may contain links to third-party websites, advertisers, services, offers, events, or activities that Bluebird does not own or control. This Privacy Policy does not apply to those third parties. Review their privacy policies before providing personal information to them.

9. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. If we make a material change, we will provide reasonable advance notice through the Service, by email, or by another appropriate method, unless the change must take effect sooner for legal, security, or safety reasons. The effective date above shows when this Privacy Policy was last updated.
